1. Scope and parties

These General Terms and Conditions of Sale ("Terms") govern every offer, order and contract concluded between Fresh Terps Gear ("we", "us", "the Seller") and any consumer or business customer ("you", "the Customer") through our online store. By placing an order you confirm that you are at least 18 years old and that you accept these Terms in full.

2. Products and intended use

We sell growing equipment, smoking accessories and cannabis seeds intended as collectibles or for use only where lawful. It is your sole responsibility to verify that the purchase, possession and use of our products are permitted under the laws of your country, region and municipality. Cannabis seeds are sold for souvenir, genetic preservation or collection purposes only, except in jurisdictions where cultivation is expressly authorised.

3. Orders and contract formation

Product listings are an invitation to treat, not a binding offer. A contract is formed only when we send you an order confirmation by email. We reserve the right to refuse or cancel any order, in particular in cases of suspected fraud, manifest pricing errors, stock unavailability or shipping restrictions in your jurisdiction.

4. Prices and payment

All prices are displayed in euros (EUR) and include applicable VAT in accordance with EU Directive 2006/112/EC. Shipping costs are added at checkout. Payment is due in full at the time of ordering through the payment methods offered on the site. Goods remain our property until full payment has been received (retention of title).

5. Shipping and delivery

We ship exclusively within Europe (27 EU Member States, United Kingdom, Switzerland and Norway). A flat shipping fee of €9.95 applies; orders over €100 ship free. Estimated delivery times are indicative; risk of loss or damage transfers to the consumer upon physical receipt of the goods, in line with Article 20 of Directive 2011/83/EU.

6. Right of withdrawal (14 days)

In accordance with the EU Consumer Rights Directive (2011/83/EU), consumers domiciled in the EU have the right to withdraw from this contract within 14 days of receiving the goods, without giving any reason. To exercise this right, contact us at info@freshterpsgear.com with a clear statement of your decision to withdraw. You must return the goods, in their original condition and packaging, within 14 days of notifying us. Direct return shipping costs are borne by you.

The right of withdrawal does not apply to sealed goods which are not suitable for return for hygiene reasons and which have been unsealed after delivery, nor to goods made to your specifications or clearly personalised.

7. Legal guarantee of conformity

Goods are covered by the legal guarantee of conformity provided by Directive (EU) 2019/771 for a minimum period of two (2) years from delivery. If a product proves defective or non-conforming, you may request repair, replacement, a price reduction or termination of the contract under the conditions set out by your national law.

8. Liability

Our liability is limited to direct damages and to the amount of the order concerned, except in cases of gross negligence, wilful misconduct or personal injury, where mandatory consumer law provides otherwise. We accept no liability for any unlawful use of our products by the Customer.

9. Intellectual property

All content on this site (texts, images, logos, designs) is protected by copyright and other intellectual property rights and remains the exclusive property of Fresh Terps Gear or its licensors. Any reproduction without prior written consent is prohibited.

10. Governing law and dispute resolution

These Terms are governed by the laws of the Seller's country of establishment, without prejudice to the mandatory consumer protection rules of the country in which the consumer resides (Rome I Regulation, EC 593/2008). Disputes may be submitted to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
